NON-REFUNDABLE DIAGNOSTIC FEE
We at Maahir will charge a non-refundable service fee (“Diagnostic Fee”) for all non-warranty visits to the Customer’s residence or business. This fee will be quoted to you prior to our visit. By accepting our service order, you confirm and acknowledge to pay the service fee in full whether Maahir technician performs the recommended repairs or not; The Diagnostic Fee will be quoted to you prior to our visit. This fee helps to cover costs by us for travel and performance of the services by Maahir technicians. b) that the Diagnostic Fee will be credited toward the cost to repair in the event that Customer agrees to have Maahir Technicians to perform the recommended repair or replacement.
ESTIMATE
Maahir provides an estimate of costs for the parts and services to repair your appliance(s) (the “Price Quote”). By accepting the service order, you agree and acknowledge to our terms of price quote and scope of work mentioned in the service order. If applicable sales tax is included in the estimated price quote.
PAYMENT TERMS AND COLLECTION COSTS
Once you accept the service order payment becomes due and will be collected upon completion of services unless agreed otherwise in a specified writing. We accept all valid checks and credit cards/debit cards. We will charge the processing fee of as per company policy for any dishonoured check or bank draft. You are liable to pay all collection expenses incurred by Maahir for any unpaid amounts including, but not limited to all filing fees, attorney’s fees and other costs. An annual rate of 20% will be charged by Maahir for all past dues amount or the maximum otherwise allowed by law, whichever is less.
LIMITED WARRANTY
We warrant you about Maahir provided services, parts and the repairs to be free from defects in material and workmanship. But the duration of this warranty is limited to thirty days from as applicable(a) date of receipt of the part. (b)repair date of service. During this thirty day period if you find out there is a defect in the repairs, parts or service you must immediately notify Maahir in writing. Maahir obligation against the warranty is limited to the replacement of that defective part or workmanship or refund of amount paid by customer for said service and parts. All warranty claims are subject to inspection and approval by Maahir.
The preceding warranties don’t apply in any manner to the following: : a) repair or replacement of any appliances used for any commercial or industrial application; b) cosmetic or non-functional parts, including but not limited to glass, trim, knobs, panels, racks, tanks, tubs, baskets, structural parts, doors, door liners, and shelves; c) plumbing supply water lines to any appliance, whether replaced or recommended for replacement by Maahir Appliance Service; d) repair of any appliance that has been moved from the location at which it was originally repaired or installed by Maahir Appliance Service; or e) repairs on appliances for which parts are no longer available from the original manufacturer.
The foregoing warranties do not apply in any manner to the following Additionally, All Maahir services shall be under no legal obligation to honour any warranty set forth herein unless the customer has paid all amounts owed under the applicable Price Quote.
THE WARRANTIES SET FORTH HEREIN ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THESE WARRANTIES EXTEND ONLY TO CUSTOMERS.
LIMITATION OF DAMAGES
Maahir shall not be responsible for any special, indirect or consequential, incidental damages which will arise from any breach of warranty, contract, Negligence or any legal theory in context with this agreement. Maahir Liability for damages will be limited to the amount actually paid by the customer. IT IS A CONSIDERED FACT THAT THIS LIMITATION DOES NOT APPLY TO CLAIMS FOR PERSONAL INJURY.
ENTIRE AGREEMENT
Maahir general terms & conditions of service including each service order establishes the complete agreement(Agreement) between customer and Maahir and it supersedes all prior or contemporaneous agreements or representations, either written or oral and even both collectively.
DAMAGE WAIVERS
Maahir provides services under waivers which are in place surrounding the provision of services Maahir provides. Customer is responsible at their own to familiarize themselves with these waivers and our price is based on the customers accepting our waivers. When you request our services, and work we perform will mean that you are accepting our waivers. Any part of these waivers if found not to be enforceable will not prevent the remaining waivers from being enforced.
WAIVER OF DAMAGES WHEN MOVING APPLIANCES
We believe that you understand the inherent risk when moving appliances. Since there is a risk of damage to machine itself and to areas around its installation, including but not limited to countertops, flooring, and cabinetry. It is considered acknowledged by you that the technician is not required to move the appliance. In exchange for his willingness to do so, you agree to hold harmless both the technician and Maahir itself from every and any liability associated with any such damage which may occur in connection with this movement.
WAIVER OF DAMAGES WHEN WORKING WITH WATER
We believe that you understand that the machinery that’s is being worked on is in connection with the plumbing system of the building. When any machinery is so connected, there is an inborn risk that any component failure, other faults, imperfect connections could result in unintended leakage and/or flooding inside the building which can cause catastrophic and sometimes significant damage. While excepting clearly proven, gross, and explicitly identifiable cases of negligence by technician, you promise to hold harmless both Maahir and its technician, its agents, its principals, and its employees from any harms or liability and damages that may result from such occurrence. You unequivocally/ explicitly waive the right to any contrary claim when you allow the technician to commence work.
WAIVER FROM FAILED COOLING APPLIANCE
The refrigeration equipment has a multiplicity of complex components like any other machinery, any of which can fail without prior warning or timeline of working. Any effort to repair/service the same carries inherent risks. Since diagnosis for troubleshooting are not always perfect and straightforward, and, even when they are performed carefully. Repairing this equipment and /or service work may lead to imperfections which could result in the failure of the machinery to perform as it is intended to perform. Such failures lead to discomfort, food spoilage, inconvenience and (especially/particularly in commercial contexts) even revenue loss as associated with failed or cancelled events, and inability to provide service to customer, etc. By undertaking to service and/or repair your equipment you acknowledge that Maahir is not accepting any responsibility for any such risks. You agree to hold harmless and exempt from any liability Maahir from all such risks and consider them your own (and/or your company’s) alone. You explicitly waive the right to any contrary claim by allowing the technician to commence work.
WAIVER FROM DAMAGES WHEN LIFTING A GLASS COOKTOP
There is an inherent risk of breakage in lifting a glass/ceramic cooktop surface to access components below and you understand that. Since the top is attached with a very strong adhesive and it very difficult and tough and not possible always to achieve such separation without surface fracturing. Our technician is expected to exercise every due level of care, you nevertheless recognize that our technician and staff explicitly refrain from accepting any responsibility of these risks. You agree all such risks are your own (and/or your company’s) alone, and you agree to hold harmless and exempt from Maahir its agents, and employees from any and all such responsibility. By allowing the technician to commence work, you explicitly waive the right to any contrary claim.
